ARKANSAS AND UNITED STATES FREEDOM OF INFORMATION ACT REQUEST

 

Fee Waiver

I make the following request pursuant to 29 U.S.C. 1746 and Arkansas FOIA laws. I am a publisher, an author and a blogger, therefore a member of the media. I own and operate, Majestic Publishers Inc. I have written numerous informative articles about how citizens can help our nation and the requested information is in the public interest. I only receive nominal financial gain from my articles that I post freely to the web. My articles and research reports are not primarily in the commercial interest of the requester. The website, press releases, informative articles in the public interest as well as a blog of Majestic Publishers is located at the website of http://www/majesticpublishers.com. I request a fee waiver due to emotional, physical and financial oppression under anti-terrorism laws where public officials are trying to entrap me with a crime by blocking my ability and fundamental right to conduct business, obtain financial gain with investments, contact other members of the media, friends, family, or even move freely since I am intentionally denied adequate medical care to much needed pain medication. My income is meager yet Majestic Publishers and my expression of First Amendment rights exist.

Expedited Processing

I request expedited processing and hope you can process this information as soon as practicable, because I will lose substantial due process rights if the records are not processed quickly. I believe the government may have acted contrary to law and Constitutional authority. We have suffered from five untimely deaths in our family. About March 12, 2010, my wife and I lost the life our unborn child, Joel Adams, on June 6, 2010, we lost the life to my Father, Clarence D. Adams, on January 1, 2011 my wife lost her Mother, Linda F. Gattis, on April 9, 2016, I lost my Brother, Robert Sean Adams and on December 26, 2016, I lost my Mother, Nancy Ellen Mayberry. My wife, Cherie L. Adams is devastated and speaks about suicide often due to the loss of her Mother and our unborn child. Cherie also suffers severe migraine headaches making life unbearable due to the eye disease keratoconus and I am trying to obtain this information to resolve this matter with civil litigation. I want to make my wife happy and to make her life worth living again with joy, instead of misery. Since my disabled wife constantly informs me that she wants to die or go to heaven and even mentions suicide because she is so miserable due to government misconduct, I am filing this Freedom of Information Act request. Please expedite these requests for information so I can adequately prepare litigation to the United States District Court for the District of Columbia to obtain due process of law to prevent any further undue harm or deaths in our family. I have a reasonable belief that the government made egregious violations of law to begin this investigation and that I am entitled to a Fourth Amendment defense as fruit from the poisonous tree. I can not obtain any fairness as required by the Fifth Amendment and the Brady rule if my communications are tampered with and you will either stop this wrongful conduct and fairly compensate us for damages because you have become aware that it is unlawful, or I will seek a dismissal of any and all criminal charges.

FOIA Request

Pursuant to the federal Freedom of Information Act, 5 U.S.C. § 552, and Arkansas FOIA laws.

1. A copy of any court orders which direct or allow your agency to tamper with our U.S. Mail delivery

2. A copy of any rules regulations, directives, laws or any other authority which direct or allow your agency or officials to tamper with our U.S. Mail delivery

3. A copy of the Church Committee reports PART IV: FBI MAIL OPENING 1. INTRODUCTION AND MAJOR FACTS (K) which contains the quotation below
The legal issues raised by the use of mail opening as an investigative technique were apparently not seriously considered by FBI officials while the programs continued. In 1970, however, after the FBI mail opening programs had been terminated, J. Edgar Hoover wrote that mail opening was “clearly illegal.”

4. Any documents, papers or effects that grant your agency the authority to overrule U.S. Supreme Court case law to tamper with our U.S. Mail delivery affording a vehicle of information and opinion

5. Any log book, photographs or notes that contain any record of the U.S. Mail tampering of Dale Adams, Majestic Publishers or my wife, Cherie Adams as I use her address label at times

6. A copy of any rules and regulations that require your agency not to tamper or interfere with the U. S. mail signaling that it is unlawful, or rules that say it is permitted

7. A copy of any rules and regulations such as Executive Order 12333, or other Presidential Directives that require your agency to comply with the U. S. Constitution

8. A copy of any rules and regulations prohibiting or allowing your agency to tamper with legal mail or a vehicle of information and opinion from a media source

9. A copy of a date stamped copy of this FOIA request as proof your agency received this

10. A copy of any documents permitting your agency to be the architect of a proceeding to secure a criminal conviction by tampering with the incoming and outgoing U.S. Mail or other communications of Dale B. Adams and his wife that does not comport with standards of justice. See e.g., Brady v. Maryland, 373 U.S. 83 (1963)

11. A copy of any and all data that permit or prohibit your agency or others from abiding by the First Amendment to allow a person to “petition the Government for a redress of grievances.”

U.S. Const. Amend. I: Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

 

12. A copy of any and all data that permit or prohibit your agency or others from abiding by the Fourteenth Amendment to allow parties to “abridge the privileges or imunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws

If my request is denied in whole or part, I ask that you justify all deletions by reference to specific exemptions of the act. I will also expect you to release all segregable portions of otherwise exempt material. I, reserve the right to appeal your decision to withhold any information or to deny a waiver of fees.
